1. Purpose

This privacy policy (“Privacy Policy”) describes the types of information The Wedding Hat LLC (“TWH”, “We”, “Us” or “Our”) collect through www.theweddinghat.com web pages, mobile applications, social media platforms and all related web pages owned and operated by Us or Our affiliates (together “Platform”) and how We will use, disclose and protect this information once it is collected. By visiting this Platform, you agree to the terms of this Privacy Policy as they may be amended from time to time.

We may share your Personal Information with third parties for their marketing purposes. You can elect for TWH not to do so by emailing Us at info@theweddinghat.com. Please make sure to include your name, mailing address/es and other contact details.

This Privacy Policy should be read in conjuncture with TWH Terms and Conditions, and is a part of TWH Terms and Conditions, which governs Our Platform and Services as a whole. Additionally, this Privacy Policy may be supplemented from time to time by other terms that apply to specific parts of Our Platform.

The Terms are effective as of 02 September 2020 (“Effective Date”).

It is important to keep personal data We hold about you accurate and current. Please keep your personal data on the Platform current during your relationship with Us.

3.1 For Users:

Identity Data includes name, email, phone number, and Facebookif you choose to log in through this method.

Profile Data includes photo, username and password, feedback and survey responses and reviews of suppliers.

Event Data includes event date, budget, number of guests, spouse names (for weddings and engagements), event role, event location, supplier bookings.

Guest List Data includes (in respect of your event guests) name, phone number, email address, and gender.

Correspondence Data includes email correspondence and Identity Data.

Usage Data includes information about how you use Our Platform.

Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

Marketing Data includes your preferences in receiving marketing from TWH.

Sensitive Data includes details about race or ethnicity, religious or philosophical beliefs, gender,information about health and genetic and biometric data.

3.2 For Vendors:

Contact Data includes supplier name, business website, business email, business phone, business address, and other information provided in the sign up and verification process.

Profile Data includes your username and password, feedback and survey responses.

Usage Data includes information about how you use Our Platform.

Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

Marketing Data includes your preferences in receiving marketing from TWH.

Correspondence Data includes email correspondence and Contact Data.

Financial Data includes information about any payments to or from TWH.

All the above for Users and Vendors (together “Participants") shall be referred to as “Personal Information”

4. Obligations of Participants (Users and Vendors)

The User agrees to make diligent use of the Platform and the services accessible through it, in full compliance with the Law, good manners and, if necessary, with any applicable particular conditions and with due respect to other Participants. TWH reserves the right to remove any content without any notice that, in its discretion, that does not meet the minimum quality requirements.

Vendors who access the Platform as professionals of the sector and who use the Platform to offer their professional services explicitly undertake to comply strictly with all and any regulations directly or indirectly affecting its activity and the professional development thereof, explicitly exempting TWH of any possible liability arising from failure to perform any of its obligations. In this regard, TWH may carry out the necessary investigations and request the documentation it deems appropriate to verify compliance with these obligations. TWH reserves the right to deny access to the Platform to those Vendors who do not provide the requested documentation or who deliberately hide it and fail to comply with the applicable regulations.

In general, the provision of Services does not require the prior registration or subscription of the Participants. However, TWH conditions the use of some of the Services to the prior completion of the appropriate Participant registration form, choosing the ID and password that the Participant agrees to keep and use with the due diligence.

The use of the password is personal and non-transferable, the transfer, even temporary, to third parties is not allowed. In this regard, the Participant must take the necessary measures for the custody of the chosen password pr eventing third parties from using it. Consequently, the Participant is solely responsible for the use of their password and TWH is fully indemnified. If the Participant knows or suspects that their password has been used or compromised by third parties, they must bring this to the attention of TWH as soon as possible.

The Participant agrees to respect the applicable laws and the rights of third parties when using the contents and services of the Platform. Moreover, the reproduction, distribution, transmission, adaptation or modification, by any means and in any form, of the contents of the Platform, (texts, designs, graphics, information, databases, sound files and/or images, logos, etc.), and other elements of this Platform, is expressly forbidden without prior authorization by its legitimate owners or when permitted by law.

In particular, the Participant is forbidden from: using libelous or slanderous contents, regardless of whether that content affects other Participants, using culturally insensitive, inappropriate or illegal content , advertising, offering or distributing culturally insensitive, inappropriate or illegal products, disturbing other Participants (especially through spam), using legally protected contents (e.g. by laws on intellectual property, trademarks, patents, utility models or aesthetic models) without being entitled to do so or advertise or offer or distribute legally protected goods or services, as well as perform or promote actions contrary to free competition, including those aimed at progressive customer acquisition (as a chain system, snowball or pyramid scheme).

The Participant is aware and voluntarily accepts that the use of the Platform and the Services provided through it occurs in all cases under the Participant’s sole responsibility

Participants are liable for damages of any kind that TWH or any third party may suffer as a result of the breach of any of the obligations set forth herein or by the law in relation to using the Platform and Services.

TWH shall not mediate conflicts between Participants or between Participants and third parties that may interfere with the proper provision of its Services and reserves the right to remove them from the Platform or to cancel any existing contract, where applicable, until any dispute or disagreement has been completely resolved.

5. How TWH may use Participant information

We (or one of Our service providers, on Our behalf) may use the Participant’s information (including your Personal Information and Platform usage information) for a variety of purposes, such as the following:

• Processing and fulfilling your transactions;

• Administering the Platform, the Platform’s features and Services, and your account with Us;

• Enabling Participants to use the Platform and the Platform’s features and Services;

• Responding to your requests, questions, and concerns;

• Developing new features and offerings on the Platform;

• Sending you marketing and other communications, including information about products, services, and events, of TWH and of others, that We think might interest you. You may opt out of receiving such notices from Us;

• Protecting Our rights and property;

• Customizing the Platform to your interests and history with Us;

• Tailoring ads displayed to you on Our Platform and elsewhere to your interests and history with Us; and

• Other purposes described at the time you choose to provide suchinformation to Us

To perform the above functions, We may match information collected from you through different means or at different times, including both Personal Information and Platform usage information, and use such information along with information obtained from other sources (including third parties) such as demographic information and updated contact information. 6. Opt In, Opt Out

If you are a Participant, Wemay use your Identity, Profile or Contact Data to send you reminder emails as part of Our Service to help with the administration of your account and to assist with managing your event. We automatically sign you up to this when you subscribe with Us. You are free to opt-out from receiving these emails at any time.

If you are a subscriber, you will also receive marketing communications from Us if you have requested information from Us or created an account with Us and, you have not opted out of receiving those marketing communications.

You can ask Us to stop sending you marketing messages or reminder emails at any time by emailing Uson info@theweddinghat.com.

7. Social Networking

We maintain presence on several social networking and blogging platforms, such as Facebook, Instagram, WordPress and Pinterest, and We also may incorporate some third-party social networking features onto Our Platform or utilize third-party provided platforms to publish or manage the Platform or portions thereof. Through these platforms and features, We receive some Personal Information and some Platform usage information about you, and this Privacy Policy applies to that information as well. In addition, some providers of third-party social networking or blogging platforms We utilize (such as Facebook, Instagram and Twitter, WordPress and Pinterest) have their own privacy policies which explain how the third parties that provide them may collect, use and protect your information (e.g., if you establish an account with such platform providers directly).

8. Mobile Apps

We may make available mobile applications ("Apps") that you are able to download to and use from your mobile device. Depending on the nature and functionality of the Apps, We may collect Personal Information and non-personally identifiable usage information through the Apps. The Appsalso may collect information about your mobile device, such as your device’s unique device ID (UDID), the IP address of your mobile device, device type, operating system and connection information (e.g., WiFi, 3G, 4G, etc.). 10. Text Message Service and Other Communication

We may seek to send messages to you on your wireless device via short message service ("Text Messaging"). By submitting your mobile phone number, you consent to receive text messages and offerings from TWH to the mobile device associated with that number using an automatic system for such purposes unless and until you elect not to receive such messages by following the opt-out instructions provided in connection the particular campaign.

You represent that you are the owner or authorized user of the device you use to sign up for Text Messaging, and that you are authorized to approve the applicable charges. You may not consent on behalf of someone else.

11. Security

We use various efforts intended to safeguard the security and integrity of Personal Information collected on the Platform. For example, where appropriate, Weuse Secure Sockets Layer (SSL), private networks and firewalls in Our system. Additionally, the servers that Westore Personal Information on are kept in a secure environment, subject to various physical access controls. Despite these measures, however, TWH cannot and do not guarantee that information will be absolutely safe from interception during transmission or intrusion during storage, while stored on Our system, or otherwise.

We have no liability for disclosure of your information due to errors or unauthorized acts of third parties during or after transmission.

12. Debit and Credit Card details

Debit and Credit Card details are not stored on Our database or server and are processed through a secure SSL environment through a third party payment gateway provider.

13. Links to other Web sites

The Platform may contain links, banners, widgets or advertisements (e.g., a "Share It!" button) that lead to other websites not subject to this Privacy Policy (including other sites that may be co-branded with Our brands). Thus, the posted policies of these other sites will govern the collection and use of your information thereon, and We encourage you to read each such privacy statement to learn about how your information may be treated by others.

14. Children under the Age of 18

The Platform is not intended for children under 18 years of age. We do not knowingly collect or store any personally identifiable information from children under the age of 18. 15. Consent To Processing In The Middle East Countries

By providing any Personal Information to TWH, all Participants, including, without limitation, Participants in the Middle East countries, fully understand and unambiguously consent to this Privacy Policy and to the transfer of such Personal Information across international borders, including the collection, storage, and processing of such information in the Middle East countries.

We may change this Privacy Policy from time to time. When We do, We will let you know by posting the changed Privacy Policy on this page with a new "Effective Date".
